Membership Eligibility

Magicencarta.com makes no representation that any products or services referred to in the materials on this website are appropriate for use, or available outside India. Those who choose to access this Site from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. Magicencarta.com will deliver the products only within India and will not be liable for any claims relating to any products ordered from outside India. Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede Magicencarta.com previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. Festive Offers

Product pictures are indicative. No two offers can be clubbed together. Magicencarta offers applicable on select brands, products and models till stock lasts. Issuance & Redemption of reward points shall be subject to terms and conditions of MagicEncarta. For any query or dispute regarding points, please contact care@magicencarta.com. Any disputes to be referred to MagicEncarta and decision of the company would be final. Disputes if any are subject to Mumbai jurisdiction only. The Company reserves the right at any time, without prior notice to add, alter, modify, change, vary and/or cancel Magicencarta.com or any of these terms & conditions at its sole discretion.

Account and Registration Obligations

If you use Magicencarta.com, you shall be responsible for maintaining the confidentiality of your User ID and Password and you shall be responsible for activities that occur under your User ID and Password. You agree that if you provide any information that is untrue, inaccurate, not current or incomplete or Magicencarta.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, Magicencarta.com has the right to indefinitely suspend or terminate or block access of your membership with Magicencarta.com. If you provide any information that is untrue, inaccurate, incomplete, or not current or if Magicencarta.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or not in accordance with the User Agreement, Magicencarta.com has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

Pricing Information

While Magicencarta.com strives to provide accurate product and pricing information, pricing or typographical errors may occur. Magicencarta.com cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Magicencarta.com shall have the right at sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, Magicencarta.com may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and Magicencarta.com will have the right to modify the price of the product and contact you for further instructions using the e-mail address provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that Magicencarta.com accepts your order the same shall be debited to your Debit Card/credit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to Magicencarta.com dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your account. We strive to provide you with the best prices possible on Magicencarta.com. Prices and availability are subject to change without notice.

Cancellation by Magicencarta.com

Due to various fraudulent activities experienced with ecommerce websites, we ensure an additional security measure for valued customers like yourself. As a part of these additional security measures, we might request you to provide relevant supporting documents (Identity proof etc). The documents shared with us are safe and will remain undisclosed to any outside party. In case the requested documents are not shared with us, Magicencarta.com reserves the right to cancel the order entirely with due intimation to the concerned person. Magicencarta.com reserves the right to cancel any order with due intimation to the concerned person, under situations where Magicencarta.com is not able to meet the requirement of the order placed. However, Magicencarta.com will ensure that any communication of cancellation of an order, so cancelled, is intimated within appropriate time to the concerned person and any applicable refund, will be made in reasonable time (within 3 business days).

Cancellations by the Customer

In case we receive a cancellation notice and the order has not been processed/approved by us, we shall cancel the order and refund the entire amount. We will not be able to cancel orders that have already been processed and shipped out by us. Magicencarta.com has the full right to decide whether an order has been processed or not. The customer agrees not to dispute the decision made by Magicencarta.com and accept Magicencarta.com's decision regarding the cancellation.

Credit Card/Debit Card Details

You agree, understand and confirm that the credit/debit card details provided by you for availing of services on Magicencarta.com will be correct and accurate and you shall not use the credit/debit card which is not lawfully owned by you, i.e. in a credit/debit card transaction, you must use your own credit/debit card. You further agree and undertake to provide the correct and valid credit/debit card details when making payment on Magicencarta.com. Your credit/debit card information never reaches Magicencarta.com, we just get pass, hold or fail message from our payment gateways. The said information will not be utilised and shared by our payment gateways or Magicencarta.com with any of the third parties unless required for fraud verifications or by law, regulation or court order. Magicencarta.com will not be liable for any credit/debit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

Replacement Policy

Replacement for products is subject to inspection and checking by Magicencarta.com team. Replacement cannot be possible if the product is burnt, damaged, broken or tampered. Magicencarta.com will not give any cash refunds. Refund is allowed only in case of manufacturing defect in the product. The defective and unused merchandise will be replaced with the same product or refunded as applicable. In case of refund of a product, customer needs to send the product back to us. Magicencarta.com shall make the refund in 15 days from return of product and acceptance of such claim. As an exception in case replacement of the defective product is not possible due to unavailability of the product then in that case we will replace the product with same value or more value product depending on the consumer choice. However, the consumer has to pay the difference. Refunds will be made by online transfer only. A cash refund is not possible for the same.

Modification of Terms & Conditions of Service

Magicencarta.com may at any time modify the Terms & Conditions of Use of the Website without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on Magicencarta.com. You should regularly review the Terms & Conditions on Magicencarta.com. In the event the modified Terms & Conditions is not acceptable to you, you should discontinue using the Service. However, if you continue to use the Service you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of Use of this Site.

Termination

Magicencarta.com may suspend or terminate your use of the Website or any Service if it believes, in its sole and absolute discretion that you have breached any of the Terms.

Entire Agreement

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. The clauses as above shall survive the termination or expiry of this agreement.

Governing Law

This agreement and each TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Mumbai.
